Plan Selection & Design

The first and most important step in the establishment of a qualified retirement plan is selecting the right type of plan for your company.  ERISA Consultants will review employer’s goals and objectives, evaluate business situation and needs, and design a qualified plan uniquely constructed to accomplish those goals and meet those specific needs.

Installation & Submission

ERISA Consultants provides a full range of IRS approved prototype plan and trust documents for use by our clients in establishing a qualified plan.  Our plans include 401(k) salary deferral, profit sharing, money purchase, new comparability plans and varying types of defined benefit plans. Although already approved by the National Office of the IRS in regard to their basic formats, we will also submit a client’s plan to the IRS for a favorable letter of determination where desired of necessary. 

ERISA Consultants provides:

Plan Administration & Compliance

ERISA Consultants provides comprehensive professional services to help employers maintain the qualified status of their employee benefit plans under the Internal Revenue Code.  Our technical services apply to all aspects of qualified retirement plans including:

  • Determination of employee and participant eligibility

  • Valuation and reconciliation of trust fund assets

  • Determination and allocation of employer contributions, trust earnings and forfeitures in defined  contribution plans

  • Calculation of appropriate funding levels for employer contributions to plans subject to Minimum Funding Standards under Internal Revenue Code Section 412

  • Preparation and maintenance of participant loan amortization schedules including calculating available loan amounts and the tacking of both principal and interest repayment.

  • Determination of participants' vested interests

  • Computation of benefit payments (in normal and optional forms) upon attainment of normal retirement age, separation of service, disability or death\

  • Performance of all non-discrimination and minimum participation testing under the Code to ensure continued qualification of the plan, including specialized non-discrimination testing for 401(k)/salary deferral plans

  • Calculation and review of age 701/2 required minimum required distribution

  • Preparation of individual participant statements summarizing all activity that has occurred on each participant’s account.

Additionally, ERISA Consultants will prepare all applicable annual filings relating to reporting and disclosure as may be required by the Internal Revenue Service, Department of Labor, Pension Benefit Guaranty Corporation or any other approved regulatory authority.

Amendment & Restatement

When changes in laws or regulations (or an employer’s goals) dictate the amendment of plan and trust documents, ERISA Consultants stands ready to provide the appropriate plan language.  We also arrange for IRS approval of the changes, if appropriate or required.

ERISA Consultants sponsors both prototypes and volume submitter plans. All documents have received are completely updated for the "GUST" law changes and all have received an IRS approval letter.

Our documents also include the EGTRRA "Good Faith Amendment" which allows employers to take advantage of the incentives offered in the latest tax act.

Plan Termination or Merger

Once a plan has completed its purpose, or if an employer so desires due to a change in business status or conditions, ERISA Consultants’ technical staff will undertake the necessary steps to successfully terminate the plan and its accompanying trust, with no negative impact on the plan’s qualified status.  We are also capable of merging previously existing plans into one vehicle upon the completion of a corporate consolidation or merger, where requested.

Education is the KEY to making any employee benefit plan successful and recognized as a benefit by those it was intended for.  Lack of consistent educational efforts on an ongoing basis will doom a plan.  Based upon our 20 years of experience as curriculum coordinators and staff for a national designation program, as well as our ongoing satisfaction of educational needs for our clients, we offer you the opportunity to fully address this key area.

ERISA Consultants will provide multi-media communication capabilities to our clients in order to assist employees in understanding and appreciating their employee benefit plan.  Our services include group presentations, one-on-one meetings with employees, customized Summary Plan Descriptions (SPDs) and other explanatory items.

Upon engaging ERISA Consultants as your third-party administrator, you receive full and unlimited access to our expert staff for all of your questions and concerns.  In effect, we offer a COST FREE lifeline that allows our clients to have the regulations AND someone who knows them, at their personal disposal.  Any questions or concerns you may have regarding your plan can be researched through a vast amount of resources available, including the latest CD-ROM regulatory library and our membership based online research sites.  All of our resources are available to you and your participant via our consultants, and there is never a charge.  Our sole focus is to assure that all of our client’s plans are in compliance at all times with the regulations set forth by the Internal Revenue Service and Department of Labor.  Our day-to-day support provides for this, as well as simplification of your life.
