PLAN DOCUMENT PROCEDURES

Our Plan Document:

ERISA Consultants provides a full range of IRS approved prototype plan and trust documents for use by our clients in establishing a qualified plan.  Our plans include 401(k) salary deferral, profit sharing, money purchase, new comparability plans and varying types of defined benefit plans. 

ERISA Consultants provides:

  • Preparation of the Adoption Agreement

  • Preparation of Summary Plan Description and simplified Summary Plan Provisions

  • Submission of all necessary documentation to the IRS (where applicable)

  • Sample Employer Resolution

Amendment or Restatement of Your Plan Document:

When changes in laws or regulations dictate the necessity for a restatement of plan and trust documents or when an employer is in need of modifications to their plan design to accommodate changing goals, ERISA Consultants stands ready to provide the appropriate plan language.  

ERISA Consultants sponsors both prototypes and volume submitter plans.  All retirement plan documents have received are completely updated for the "GUST" law changes and all have received an IRS approval letter.  All of our Section 125 plan documents are updated for the most recent changes in regulations (which took effect in 2000).

Our retirement plan documents also include the EGTRRA "Good Faith Amendment" which allows employers to take advantage of the incentives offered in the latest tax act.

If you are contemplating a change to your plan design, the process is as follows:

Contact our office as soon as possible.  Depending on the type of change desired, the deadline could be as early as the first day of the plan year or as late as the due date for filing your tax return.

Discuss the change with a plan consultant.  Even the most simplistic changes can have unanticipated consequences that you should consider prior to finalizing your decision.

Once you have made a final decision, ERISA Consultants must be informed in writing prior to preparing a plan amendment. 

Your amendment will be processed by ERISA as soon as administratively feasible.  You will be sent all documentation necessary to update your plan document, Summary Plan Description and Summary of Plan Procedures.  We will also make our best effort to supply new operational forms for to replace those affected by the change.

Please review all items carefully.  The employer, as the formal Plan Administrator, and the trustee (often the same party) must execute the documents before they actually take effect.  The execution of plan documents is also referred to as "adoption".  It is important that the you adopt your amendment by the
